1. Acceptance
By creating a Pigment House account or using the service you agree to these terms and to our Privacy Policy. If you don't agree, don't use the service. We may ask you to re-accept these terms when they change materially.
2. Who can use it
You must be at least 16 years old (or the digital-consent age in your country) to use Pigment House. By signing up you confirm you meet that threshold and that the information you provide is accurate.
3. The service
Pigment House provides studio tools for visual artists — AI-assisted palette extraction, prompt generation, stencil creation, gallery hosting, a marketplace, and studio management. Features may change as the product evolves and individual tools may be added, modified, or retired.
4. Tattoo Ink — important disclaimer
Pigment House includes a "Tattoo Ink" medium that returns colour references for tattoo inks. This feature is provided solely as a colour-reference aid for licensed, insured, professional tattoo artists. It is not a tattooing course, a certification, a medical resource, or a substitute for proper training, apprenticeship, sterilisation procedure, regulatory compliance, or professional insurance.
By selecting the Tattoo Ink medium you confirm that you are a licensed and insured tattoo artist operating in compliance with the laws, health regulations, and licensing requirements of your jurisdiction. You agree that you alone are responsible for any tattooing you perform, including selection of inks, equipment, hygiene, client consent, aftercare, and outcomes.
To the maximum extent permitted by law, Pigment House disclaims all liability for any harm, injury, allergic reaction, infection, scarring, fading, migration, healing complication, financial loss, or claim arising from or related to tattooing — whether or not Pigment House's colour reference was used. Pigment House does not verify user credentials and provides no warranty that any referenced ink is safe, legal in your jurisdiction, or suitable for any individual client.
If you are not a licensed tattoo artist, do not use the Tattoo Ink medium and do not use Pigment House output to attempt tattooing.
5. Your content
You retain ownership of everything you upload (reference photos, artwork, notes, palettes, listings). You grant Pigment House a worldwide, non-exclusive, royalty-free licence to host, store, process, transmit, display, and create derivative works of your content solely so we can operate and improve the service for you. You confirm you have the rights to anything you upload and that it does not infringe third-party copyright, trademark, privacy, or publicity rights.
6. Acceptable use
You agree not to use Pigment House to: (a) infringe intellectual property; (b) generate or distribute illegal, harmful, defamatory, hateful, or sexually explicit material involving minors; (c) harass, dox, or impersonate any person; (d) attempt to disrupt, reverse-engineer, scrape at scale, or attack the service; (e) misuse the Tattoo Ink feature in violation of section 4. We may suspend or terminate accounts that breach this section.
7. AI output
AI-generated content (palettes, stencils, prompts, critiques, mixing notes) is provided "as is" and may be inaccurate, incomplete, or unsuitable for a particular use. You are responsible for reviewing AI output before relying on it, including for any commercial or professional purpose. Where outputs are derived from third-party models, those providers' terms may also apply.
8. Marketplace
The marketplace is a discovery surface that lets artists list original works and accept commission enquiries. Pigment House is not a party to any sale or commission: transactions, payments, shipping, taxes, refunds, and disputes are strictly between the artist and the buyer. We do not vet listings, verify originality, or guarantee authenticity. Use independent judgement and your own contracts.
9. Subscriptions and billing
Paid plans are billed via Stripe in the currency shown at checkout. New accounts receive a free trial of the length advertised at signup. You can cancel any time from the account page — access continues until the end of the paid period. Refunds are handled case by case; contact us within 14 days of charge if there is a problem. Where required by law (including the Australian Consumer Law and EU consumer rights), your statutory rights are not affected.
10. Account termination
You can delete your account at any time. We may suspend or terminate accounts for breach of these terms, non-payment, fraud, or legal/regulatory reasons. On termination your access ends and we may delete your content after a reasonable retention period, except where we are required to keep records (e.g. tattoo-artist confirmations under section 4, billing records, legal holds).
11. Limitation of liability
To the maximum extent permitted by law, Pigment House is provided "as is" without warranties of any kind. We are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, lost profits, lost data, or business interruption. Our total aggregate liability to you for any claim arising from or related to the service is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) USD 50. Nothing in these terms limits liability that cannot lawfully be limited (e.g. consumer guarantees, gross negligence, or wilful misconduct).
12. Indemnity
You agree to indemnify and hold Pigment House harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your content, your use of the service, your breach of these terms, or — in the case of tattoo artists — any tattooing you perform.
13. Privacy
Our handling of personal data is described in the Privacy Policy. When you accept these terms or confirm tattoo-artist status, we record the timestamp, the version of the terms accepted, your IP address, and your browser user-agent for record-keeping and legal-defence purposes.
14. Changes
We may update these terms from time to time. Material changes will be announced in-app and you may be required to re-accept the updated terms to continue using the service. Continued use after acceptance means you agree to the new version.
15. Governing law
These terms are governed by the laws of Queensland, Australia. Any dispute arising out of or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Queensland.
